We at Daily Paws and its parent BMP Holdings LLC (together “Daily Paws”) value the privacy of our users and members. If you’ve hidden a bone or some catnip in a secret place, we have no intention of ever revealing it. This privacy policy describes how we treat the personal information of our members and pertains to the use of the Daily Paws web site at www.dailypaws.com. This Privacy Notice is incorporated into and is subject to the Daily Paws Terms of Use. DAILY PAWS TERMS OF USE

It seems like nowadays even pets have lawyers, and ours have insisted that we include these terms of use. The Daily Paws website (www.dailypaws.com) and its parent BMP Holdings LLC (together, “Daily Paws”) want to give users an opportunity to share with others their experiences of animals. This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the Daily Paws website (the “Website”). By using the Website, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Daily Paws Website) or you are a "Member" (which means that you have registered with Daily Paws). The term "User" refers to a Visitor or a Member. You are only authorized to use the Website (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the Website and discontinue use of it immediately. Daily Paws hereby grants you permission to use the Website as set forth in this Agreement, provided that: (i) your use of the Website as permitted is solely for your personal, noncommercial use except as specifically authorized by Daily Paws; (ii) you will not copy or distribute any part of the Website in any medium without Daily Paws' prior written authorization; (iii) you will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose; and (iv) you will otherwise comply with the terms and conditions of this Agreement.

In order to access some features of the Website, you will have to register and create an account. You may never use another User’s account without our or the User’s written permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs in your account for any reason, and you must keep your account password secure. You must notify Daily Paws immediately of any breach of security or unauthorized use of your account. Daily Paws will not be liable under any circumstances for your losses caused by any unauthorized use of your account regardless of how such losses occurred; however you may be liable for the losses of Daily Paws or others due to such unauthorized use.

All rights are reserved. You are solely responsible for the photos, profiles and other content that you publish or display (hereinafter, "post") on or through the Website (collectively the "Member Content"). You understand and agree that Daily Paws may review and delete or remove any Member Content that in the sole judgment of Daily Paws violates this Agreement or which might be offensive, defamatory, illegal, or that might violate the rights, harm, or threaten the safety of Members or others. To that extent, Daily Paws will use its commercially reasonable efforts to police the site for offensive content; however, DailyPaws cannot and does not guarantee that all offensive content will be removed promptly or at all.

DailyPaws is only a forum where persons can obtain and share information about animals and pets. Therefore, you understand and agree that, from time to time, Users may comment and/or vote on your Member Content, including your pet. You agree that you post and display all Member Content at your own risk and hereby release, indemnify, and hold harmless Daily Paws from and against any and all damages and claims of any kind related to your Member Content and/or any statements or actions of any Users or third-parties related to your Member Content.

You retain all ownership rights in your Member Content, and you continue to have the right to use your Member Content however you choose. However, by posting Member Content to any part of the Website, you automatically grant, and you represent and warrant that you have the right to grant, to Daily Paws (and its successors) an irrevocable, perpetual, non-exclusive, transferable, fully paid, royalty free, worldwide license (with the right to sublicense) to use, copy, republish, perform, display, reformat, translate, excerpt (in whole or in part) and distribute such information and Member Content and to prepare derivative works of, or incorporate into other works, such information and Member Content, and to grant and authorize sublicenses of the foregoing. You further agree, represent and warrant that none of your Member Content infringes the rights of any third-parties.

You may remove your Member Content from the Website at any time. Daily Paws also may remove your Member Content at any time in its sole discretion. No Member has any right to require Daily Paws to post or continue to post its Member Content.

In connection with Member Content, you further agree that you will not: (i) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Daily Paws all of the license rights granted herein; (ii) publish falsehoods or misrepresentations that could damage Daily Paws or any Member or third party; (iii) submit or post material, including but not limited to Member Content, that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iv) post advertisements or solicitations of illegal or inappropriate businesses; (v) impersonate another person; or (vi) categorize animals inappropriately; (vii) fail to disclose any material information regarding any pet being offered for adoption on the Website, whether or not a User looking to adopt a pet requests said information. Daily Paws does not endorse any Member Content or any opinion, recommendation, or advice expressed therein, and Daily Paws expressly disclaims any and all liability in connection with Member Content and any third party websites, content and advertisements. Daily Paws does not permit copyright infringing activities and infringement of intellectual property rights on the Website, and Daily Paws will remove Member Content if properly notified that such all Member Content infringes another's intellectual property rights. Daily Paws reserves the right to remove Member Content without prior notice. 
It is the policy of Daily Paws to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of prompt notification to Daily Paws by the copyright owner or the copyright owner's legal agent or who otherwise violates the letter or spirit of this Agreement. Daily Paws is not responsible for any incorrect, defamatory, offensive or inaccurate Content or Member Content posted on the Website or in connection with the Website, whether caused by Users of the Website, third party providers of content, third-party websites (such as MySpace or Facebook) or advertisements, or by any of the equipment or programming associated with or utilized in the Website. Certain content and Member Content, including, but not limited to, training, health or grooming tips, pet ratings, and pet adoption information may be provided by Members and/or third parties. Such content consist of personal opinions and recommendations only. Daily Paws does not investigate or confirm the accuracy or medical reliability of any Member Content or third party content, including any pet tips, makes no representations or warranties regarding the accuracy of such information or otherwise, and disclaims any warranties or claims regarding such content. Certain Users may post Member Content that promotes their products or services, including, but not limited to, pet adoption, pet photography or pet training. Daily Paws is not responsible for such products or services, and does not investigate such products or services, and expressly disclaims any warranties or claims regarding such products or services. Daily Paws makes no representation whatsoever regarding any pet being offered for adoption. Profiles created and posted by Members on the Website may contain links to other websites. Daily Paws is not responsible for the content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by Daily Paws. Inclusion of any linked website on the Website does not imply approval or endorsement of the linked website by Daily Paws. When you access these third-party sites, you do so at your own risk. Daily Paws takes no responsibility for third party advertisements which are posted on this Website or through the Website, nor does it take any responsibility for the goods or services provided by its advertisers. LIMITATION ON LIABILITY

ASSIGNMENT

This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Daily Paws without restriction.

OTHER

This Agreement is accepted upon your use of the Website or any of the Website and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and Daily Paws regarding the use of the Website. The failure of Daily Paws to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. Daily Paws is a trademark of BMP Holdings LLC. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
